NJ Post-nuptial Mediation
Post-nuptial agreements are similar to prenuptial agreements except they are executed after a marriage. They can be used for many items such as pre-planning a divorce, changing a prenuptial agreement or helping couples agree upon marital arrangements such as financial issues, chores, etc.
I have had some divorce mediations find the couple reconciling (perhaps as a result of better communications via the mediation) and not want to waste the work that went into the divorce mediation in case things do not work out. I converted the Memorandum of Understanding into a post-nuptial agreement for their attorneys to review.
Mediation is an ideal setting to negotiate a post-nuptial agreement. Mediation is a collaborative environment rather than an adversarial one often used by lawyers. Post-nuptial agreements, while not mandated by New Jersey law, should always be reviewed by an attorney. This will minimize the risk of such an agreement not being upheld because of lack of full disclosure, undue influence or duress.
